Copyright Law is a funny thing. Typically the guideline is that Free allows it's use. This is why for example it's legal (And has been upheld) to do something like make a copy of a music CD and give it to a friend.

Making a profit off it though puts it strictly in the category that if Rooster Teeth ever felt like taking the artist to court over it... open and shut case, they'd win.

Most people skirt by this because they allow it to be posted up for free. It's a technicality that lets them profit off it if they say "I'm not actually selling it... I'm putting it out there for free. And people happen to give me money for unrelated reasons".

But if he kept it strictly behind a Patreon Paywall... yeah legally he could get hammered. Reason he doesn't is basically it's too small to care about. Or because the IP holder might encourage it as basically free advertising. But they could push it if they wanted. Give him a Cease and Desist Order, failure to comply leading to a summary judgement.
