like, I totally agree with the "fuck Nintendo" mindset, but also, a porn comic using copyrighted characters really dosn't fall under any of the factors of fair use; it's not actually parody unless it has to say something about the property.

Ironically, a comic wherein the characters are actually getting censored and replaced in-universe because of a nintendo copyright claim might actually be able to argue parody for fair use.

This is actually okay as long as the artist isn't making money on the comic. You can be sued if you make a comic using copyrighted characters of someone else's without their permission. Drawing comics and fanart of copyrighted characters is legal, making money off someone else's copyrighted characters without their permission is illegal. As long as they aren't being paid money in some form like via patreon for example for drawing pokemon, digimon, et cetera then no worries.
