IMHO it's cool that AI can remix illustrations and retrieve remixes by a text prompt, but none of this would be possible if we hadn't digitized and made available a huge collection of human-created artwork. Right now it still takes a good prompt and curation from a human to separate decent results from all the trash, and I'm willing to bet crafting good prompts that produce a precise result will become an art form in itself. Humans will have to keep creating art if we expect the AI's output to remain relevant.

Also agreed with csy1997 that this is a remixed database of human artists' creations, and if they're not getting credited it's kind of shitty to use their work indirectly.

And yeah, as neat as all this is, it ain't getting me there, at least not yet.

The problem with original artists getting credit for their work being in the training samples is very similar, in my opinion at least, to the way that sampling works in the music industry. Sampling is a widely used practice and is not always grounds for copyright infringement. There are two main ways a challenge to a given example of sampling can be defeated, the sampling can be considered "de minimus" - the sampling being impossible to notice from a lay person's perspective -, and the fair use defense, wherein the amount of the sampled work, the financial effect the sampling had on the copyright holder, and the degree of transformation that the sample undergoes are considered and weighed. There isn't a "one size fits all" to fair use, so you can eyeball those factors and probably make a reasonable guess as to whether AI art is fair use or not.

While I'm not incredibly well versed in how much an AI samples from any given source, given how massive the image pools are it would be nearly impossible to prove that the AI took from any given source to a degree that a "lay person" would understand. As such, the "de minimus" defense would likely prevail in individual pieces. In aggregate, it might work to go after the dataset generally because the AI is unable to produce anything without a dataset to begin with, but that seems weak to me. You have to prove damages to a court, not hypothetically state that a data set might be harmful towards you if used for a certain purpose. This is an area that needs legislation rather than litigation, otherwise rightsholders are going to be left in the dust by the new industry.

It's a great tool to generate images on the own pc but not to upload these online to flood several sites with these kind of images. Not only many images just looks weird (which will probably improve over the years), it's just not art and will suppress (?) actual human artists.
