That's an opinion. In most countries until quite recent times, including and even especially in U.S and european countries, nudity was often deemed pornographic.
Anyway for EH purposes we have only to use EH definitions, not our opinions; otherwise we would get all kind of different opinions about it, since this is a multi-cultural site, both in users and contents.

Most probably because they were dupes, already uploaded (sometimes looking if something already exists in EH is a difficult exercise, since titles/authors are not always correctly/reliably written)

The ruling on "non-H is determined by publisher" is to ensure 'ecchi' manga that definitely crossed the line into hentai are still treated as the same copyright issue for expunging Forbidden content, not for our own category definitions.
