I'm assuming the sniper held back from shooting because everyone believed the explosives were a real threat and it was dangerous to cause the villain to let go of the detonator. Once he dropped it by accident and everyone could tell it was all a bluff, the sniper still wouldn't shoot because he was no longer a threat. Hero knew all that would follow was going to be an arrest, so he did the right thing and at least shot him dead.

No, the fucking sniper literally said "lets wait" because the leader of the operation was held hostage, even though they got various chances for several clean shots he refused to because "they lost the chain of command".
